Deposit Insurance Coverage: Limits, Aggregation, and Capacity Rules
Comprehensive guide to DICGC deposit insurance coverage in India, detailing the ₹5 lakh ceiling, branch aggregation, same right and capacity rules, and interest treatment.
Statutory Coverage Limit and the Five Lakh Ceiling
Every depositor placing hard-earned savings into a bank expects safety and liquidity. While the statutory mandate of the Deposit Insurance and Credit Guarantee Corporation (DICGC) provides the regulatory foundation for this safety, the actual financial shield experienced by a saver is defined by the deposit insurance coverage limit.
Under Section 16(1) of the DICGC Act, 1961, the Corporation provides insurance protection to every depositor up to a statutory ceiling. Effective from February 4, 2020, the Government of India and the Reserve Bank of India raised this ceiling to ₹5,00,000 (Rupees Five Lakh) per depositor per bank. This replaced the earlier threshold of ₹1,00,000, which had remained unchanged for nearly 27 years.
This protection applies uniformly across all insured commercial banks, regional rural banks, local area banks, small finance banks, payments banks, and eligible cooperative banks across India. According to recent data from the DICGC, this ₹5 lakh limit fully protects approximately 97.4% of all bank deposit accounts in India, well above the international benchmark of 80% recommended by the International Association of Deposit Insurers (IADI).
Historical Evolution of the Insurance Ceiling
The deposit insurance ceiling has undergone seven revisions since the inception of the scheme in 1962. Each revision reflected evolving economic conditions, rising per-capita incomes, and the expansion of the banking network.
| Effective Date | Statutory Insurance Ceiling | Historical Context and Milestones |
|---|---|---|
| January 1, 1962 | ₹1,500 | Inception of the Deposit Insurance Corporation (DIC) following the collapse of Laxmi Bank and Palai Central Bank. |
| January 1, 1968 | ₹5,000 | First upward revision, coinciding with the extension of insurance to eligible cooperative banks. |
| April 1, 1970 | ₹10,000 | Expansion to match rising deposit values and economic activity. |
| January 1, 1976 | ₹20,000 | Upward revision during the decade when Regional Rural Banks were established and brought under the safety net. |
| July 1, 1980 | ₹30,000 | Revision following the merger of DIC with the Credit Guarantee Corporation of India to form DICGC in 1978. |
| May 1, 1993 | ₹1,00,000 | Sharp increase implemented post-liberalization to reinforce public trust during financial sector reforms. |
| February 4, 2020 | ₹5,00,000 | Fivefold increase introduced to strengthen depositor confidence following crises in urban cooperative banks. |
Mechanics of the Insurance Cap: Principal, Interest, and Set-Off Rules
The statutory limit of ₹5 lakh is an absolute ceiling per depositor. To understand how claim calculations operate during a bank resolution, three primary factors must be evaluated: the combination of principal and interest, the interest cut-off date, and the bank’s right of set-off.
Principal and Accrued Interest Combined
The insurance limit does not apply separately to the money deposited and the interest earned. Instead, it covers the aggregate of principal and accrued interest.
-
Full Coverage Scenario: If a customer maintains a principal deposit of ₹4,75,000 and has earned accrued interest of ₹20,000, the total claim stands at ₹4,95,000. Because the combined figure is under ₹5 lakh, the entire ₹4,95,000 is fully reimbursed.
Partial Loss Scenario: If a customer holds a fixed deposit with a principal value of ₹5,00,000 and accumulated interest of ₹35,000, the gross claim is ₹5,35,000. The DICGC pays out the maximum ceiling of ₹5,00,000. The remaining ₹35,000 represents an uninsured claim that can only be recovered through the bank liquidator if surplus assets remain after settling priority claims.
Excess Principal Scenario: If a depositor holds a principal amount of ₹7,00,000 alongside ₹40,000 in accrued interest, the total balance is ₹7,40,000. The insurance payout remains strictly capped at ₹5,00,000.
The Interest Cut-Off Date
Interest does not accumulate indefinitely once a bank runs into regulatory distress. For deposit insurance calculations, interest is computed strictly up to the statutory cut-off date.
The cut-off date is defined by the earliest occurrence of one of the following official events:
-
The date on which the Reserve Bank of India cancels the banking license.
The date on which an order for winding up or liquidation of the bank is passed by a competent court or the central/state registrar.
The date on which the bank is placed under All-Inclusive Directions (AID) by the RBI, imposing caps on customer withdrawals.
Any interest that would have theoretically accrued under normal deposit contract terms after this cut-off date is disregarded for insurance calculation purposes.
The Statutory Right of Set-Off
Under Section 16(3) of the DICGC Act, 1961, the deposit insurance payout is determined on a net liability basis. If a depositor also owes money to the bank through loans, cash credit facilities, or overdrafts, the liquidator exercises the right of set-off before determining the eligible insurance claim.
The set-off mechanism works as follows:
-
Calculate Total Deposit Entitlement: Total deposits plus accrued interest up to the cut-off date.
Calculate Total Loan Dues: Outstanding principal balance plus accrued interest on the loan up to the cut-off date.
Netting: Deduct total loan dues from the total deposit entitlement.
Apply Insurance Ceiling: The DICGC covers the resulting net payable balance up to a maximum of ₹5,00,000.
Consider a depositor with a fixed deposit of ₹6,50,000 and an outstanding personal loan of ₹2,50,000 in the same bank. The bank nets the loan against the deposit, leaving a net deposit of ₹4,00,000. The DICGC settles the full ₹4,00,000 because it falls within the ₹5 lakh ceiling. If the initial deposit were ₹9,00,000 and the loan ₹2,00,000, the net deposit balance would be ₹7,00,000, and the depositor would receive the maximum insurance cap of ₹5,00,000.
Branch Aggregation and Bank-Wise Insurance Ceiling
A frequent question among bank customers is whether splitting money across multiple branches of the same bank increases their insurance protection. The legal framework provides a straightforward answer: deposit insurance is administered on a per bank basis, never on a per-branch basis.
The Aggregation Rule Across Branches
All branches of an insured bank belong to a single corporate entity. Whether an institution has ten branches or ten thousand branches across India, the DICGC treats the entire branch network as one bank.
-
Cross-Branch Clubbing: All deposits held by a customer in different branches of the same bank are clubbed together. If you maintain a savings account at a branch in Delhi and a fixed deposit at a branch in Bengaluru within the same bank, their balances are consolidated.
Cross-Product Clubbing: The aggregation rule applies across different deposit products. Balances held in savings accounts, current accounts, fixed deposits (term deposits), and recurring deposits in the same bank are added together into a single total balance.
| Account Type | Branch Location | Principal + Accrued Interest | DICGC Treatment |
|---|---|---|---|
| Savings Account | Branch A (Connaught Place) | ₹1,20,000 | Clubbed into single bank total |
| Fixed Deposit | Branch B (Indiranagar) | ₹2,80,000 | Clubbed into single bank total |
| Recurring Deposit | Branch C (Salt Lake) | ₹1,60,000 | Clubbed into single bank total |
| Consolidated Total | Same Bank Total | ₹5,60,000 | Total Insured: ₹5,00,000 (Uninsured: ₹60,000) |
In this scenario, even though the money is distributed across three branches and three different deposit products, the total claimable insurance remains capped at ₹5,00,000. The excess ₹60,000 remains uninsured.
Independent Coverage Across Separate Banks
While deposits within the same bank are aggregated, the ₹5 lakh insurance limit applies independently to each separate insured bank.
If a depositor distributes savings across multiple distinct licensed banks, each bank carries its own standalone insurance cover of up to ₹5 lakh. For instance, if an individual deposits ₹5,00,000 in Bank A, ₹5,00,000 in Bank B, and ₹5,00,000 in Bank C, the entire ₹15,00,000 enjoys full statutory insurance protection.
Following bank amalgamations, depositors must be mindful of corporate consolidations. When two banks merge into a single entity, branches of the acquired bank become branches of the acquiring bank. Consequently, deposits held in both institutions become subject to a single aggregated ₹5 lakh limit under the merged entity.
The “Same Capacity and Same Right” Doctrine
The most significant legal nuance in deposit insurance is the principle of capacity and right. Under Section 16 of the DICGC Act, 1961, deposits are clubbed together only when they are held in the same capacity and the same right.
If a customer maintains multiple accounts in the same bank under different capacities and different rights, those accounts are not aggregated. Each distinct legal capacity qualifies for an independent insurance coverage ceiling of up to ₹5,00,000 within that same bank.
Understanding Capacity and Right
In legal terms, capacity refers to the role or standing in which a person opens and operates an account (for example, as an individual, as a trustee, or as a partner). Right refers to the legal beneficial ownership of the underlying funds.
When both the capacity and the right are identical across accounts, the DICGC consolidates them into a single claim. When either the capacity or the right is legally distinct, separate insurance shields apply.
The Sole Proprietorship Exception
A common area of confusion involves sole proprietorship businesses. Under Indian commercial law, a proprietary concern does not possess a separate legal identity distinct from its proprietor.
Because the business and the individual owner are the same legal entity, a current account opened in the trade name of a sole proprietorship is held in the same capacity and same right as the owner’s personal savings account.
If an individual holds ₹3,50,000 in a personal savings account and ₹2,50,000 in a sole proprietorship business account at the same bank, the total balance of ₹6,00,000 is clubbed together. The DICGC settles only up to the ₹5,00,000 ceiling, leaving ₹1,00,000 uninsured.
Fiduciary, Entity, and Representative Capacities
Unlike a sole proprietorship, various other accounts reflect distinct legal personalities or fiduciary responsibilities. The DICGC recognizes these as separate capacities, granting each an independent ₹5 lakh insurance limit in the same bank:
-
Individual Capacity: Deposits maintained in a person’s sole personal name.
Partner in a Partnership Firm: An account maintained by a registered partnership firm is legally owned by the firm. It is insured separately from the personal accounts of its partners.
Director of a Company: A registered private or public limited company is an independent legal entity. The company deposit is insured separately from the personal deposits of its directors or shareholders.
Guardian of a Minor: When a parent or guardian opens an account on behalf of a minor child, the funds legally belong to the minor. This account is treated as held in a separate capacity and is not clubbed with the guardian’s personal deposits.
Trustee or Executor: Accounts operated by a person in the capacity of a trustee of an registered trust or executor under a will are held in a fiduciary capacity and receive separate insurance coverage.
| Account Representation | Legal Capacity and Right | DICGC Insurance Treatment |
|---|---|---|
| Personal Savings Account | Individual personal capacity | Insured separately up to ₹5 lakh |
| Sole Proprietorship Current Account | Same as individual (no separate legal entity) | Clubbed with personal account (single ₹5 lakh limit) |
| Partner in Partnership Firm Account | Partnership capacity | Insured separately up to ₹5 lakh |
| Director in Private Limited Company Account | Corporate body capacity | Insured separately up to ₹5 lakh |
| Guardian on Behalf of Minor Account | Fiduciary capacity for minor | Insured separately up to ₹5 lakh |
| Trustee of a Registered Trust Account | Fiduciary capacity as trustee | Insured separately up to ₹5 lakh |
Joint Account Treatment and Name Sequencing Rules
Joint bank accounts represent one of the most widely used methods for managing household savings in India. Under DICGC regulations, joint accounts operate under specific legal rules where the sequence of names directly establishes distinct rights and capacities.
The Significance of the Primary Account Holder
In Indian banking practice, the first-named holder in a joint account is the primary account holder. For deposit insurance purposes:
-
If a person holds an individual account in their sole name and also holds a joint account with another person, the two accounts are held in different capacities and different rights.
Consequently, personal deposits are never clubbed with joint deposits.
The Name Order Rule (Permutations of Names)
The DICGC determines whether two joint accounts are aggregated based on the exact combination and ordering of the account holders:
-
Identical Combination and Order: When two or more joint accounts feature the exact same holders in the exact same sequence (for example, Account 1: Ramesh and Sunita, and Account 2: Ramesh and Sunita), they are held in the same capacity and right. The balances across both accounts are consolidated and capped at a single ₹5,00,000 limit.
Reversed or Altered Order: When the order of names is altered (for example, Account 1: Ramesh and Sunita, and Account 2: Sunita and Ramesh), the two accounts are legally treated as held in different capacities and rights. Each combination qualifies for an independent insurance limit of up to ₹5,00,000 within the same bank.
Different Combinations: Adding or replacing a co-holder (for example, Ramesh and Sunita versus Ramesh and Rahul) creates an entirely separate legal entity group, conferring an independent ₹5,00,000 insurance ceiling.
Practical Application: Maximizing Protection within a Single Bank
By leveraging distinct capacities and name sequencing, a household can legally safeguard significant funds within a single insured bank without exceeding the statutory insurance threshold for any single account.
Consider a family of two individuals, Rajesh and Kavita, holding multiple deposit accounts in the same commercial bank:
| Account Number | Account Title and Mode | Balance (Principal + Interest) | Capacity and Right | Insured Amount | Uninsured Balance |
|---|---|---|---|---|---|
| Account 1 | Rajesh (Single / Sole) | ₹5,00,000 | Individual Capacity (Rajesh) | ₹5,00,000 | Nil |
| Account 2 | Kavita (Single / Sole) | ₹5,00,000 | Individual Capacity (Kavita) | ₹5,00,000 | Nil |
| Account 3 | Rajesh & Kavita (Joint) | ₹5,00,000 | Joint Capacity (First holder: Rajesh) | ₹5,00,000 | Nil |
| Account 4 | Kavita & Rajesh (Joint) | ₹5,00,000 | Joint Capacity (First holder: Kavita) | ₹5,00,000 | Nil |
| Total Holdings | Across Four Accounts | ₹20,00,000 | Four Distinct Capacities | ₹20,00,000 | Nil |
In this structure, all four accounts are fully protected by the DICGC up to a total of ₹20,00,000 in the same bank. Because each account configuration embodies a distinct legal capacity and right under Section 16, no clubbing occurs across these four arrangements.

All deposit balances across different branches and schemes of the same bank are aggregated into a single consolidated balance.
Deposits maintained across different insured banks enjoy separate, independent insurance coverage of up to ₹5 lakh per bank.
Accounts held in different capacities and rights (such as personal, partnership, corporate, guardian, and trustee) receive separate ₹5 lakh coverage ceilings in the same bank.
A sole proprietorship account is aggregated with the owner’s personal account because the business lacks a separate legal identity.
